Gwnaeth y DU gadarnhau (cytuno i ddilyn) OPCAT yn 2003.<\/p>\n<p>Sefydlodd OPCAT yr Is-bwyllgor ar Atal Artaith a Thriniaeth neu Gosb Greulon, Annynol neu Ddiraddiol eraill (<a href=\"https:\/\/www.ohchr.org\/en\/treaty-bodies\/spt#:~:text=The%20Subcommittee%20on%20Prevention%20of,of%20torture%20and%20ill%20treatment.\">SPT<\/a>). Nod pennaf SPT, sydd yn cynnwys 25 o arbenigwyr annibynnol a diduedd, yw atal artaith a chamdriniaeth. Bydd SPT yn ymweld \u00e2 llefydd lle caiff pobl eu hamddifadu o\u2019u rhyddid er mwyn archwilio amodau cadw. Bydd hefyd yn helpu Gwladwriaethau i sefydlu cyrff cenedlaethol i fonitro lleoedd cadw ac atal artaith a chamdriniaeth. Gelwir y cyrff hyn yn Fecanweithiau Ataliol Cenedlaethol.<\/p>\n<p>Drwy gadarnhau OPCAT, cytuna\u2019r DU i:<\/p>\n<ul>\n<li>Ganiat\u00e1u aelodau <a href=\"https:\/\/www.ohchr.org\/en\/treaty-bodies\/spt#:~:text=The%20Subcommittee%20on%20Prevention%20of,of%20torture%20and%20ill%20treatment.\">SPT<\/a> i ymweld \u00e2 lleoedd lle caiff pobl eu harestio, carcharu neu gadw\u2019n gaeth \u2013 megis gorsafoedd yr heddlu, carchardai (y fyddin a sifiliaid), canolfannau cadw mewnfudwyr, a sefydliadau iechyd meddwl a gofal cymdeithasol<\/li>\n<li>Sefydlu Mecanwaith Ataliol Cenedlaethol i fonitro\u2019n annibynnol cadw a charcharu pobl yn y DU<\/li>\n<\/ul>\n<p>Sefydlodd y DU <a href=\"https:\/\/www.nationalpreventivemechanism.org.uk\/\">Fecanwaith Ataliol Cenedlaethol<\/a> yn 2009.<\/p>\n<h2>Sut mae SPT yn cynnal ei waith monitro?<\/h2>\n<p>Bydd yr SPT yn casglu gwybodaeth drwy gynnal ymweliadau \u00e2 gwledydd. Yn ystod yr ymweliadau hyn, bydd gan aelodau\u2019r SPT fynediad anghyfyngedig i gwrdd ag unrhyw un sydd yn gallu darparu gwybodaeth berthnasol am amodau cadw, gan gynnwys:<\/p>\n<ul>\n<li>Pobl sydd yn cael eu hamddifadu o\u2019u rhyddid<\/li>\n<li>Swyddogion llywodraeth<\/li>\n<li>Aelodau\u2019r Mecanwaith Ataliol Cenedlaethol<\/li>\n<li>Cynrychiolwyr sefydliadau hawliau dynol cenedlaethol<\/li>\n<li>Sefydliadau anllywodraethol<\/li>\n<li>Staff carcharu<\/li>\n<li>Cyfreithwyr<\/li>\n<li>Doctoriaid<\/li>\n<li>Aelodau teulu\u2019r sawl sydd yn cael ei gadw\u2019n gaeth<\/li>\n<\/ul>\n<p>Pan ddaw ei ymweliad i ben, bydd yr SPT yn llunio dau adroddiad yn cynnwys sylwadau ac argymhellion. Bydd un adroddiad i Lywodraeth y DU a\u2019r llall i\u2019r Mecanwaith Ataliol Cenedlaethol. Bydd y ddau adroddiad yn gyfrinachol, a gallai Llywodraeth y DU a\u2019r Mecanwaith Ataliol Cenedlaethol ddewis i\u2019w cyhoeddi.<\/p>\n<p>Bydd gan Lywodraeth y DU wedyn chwe mis i lunio ymateb ysgrifenedig i SPT, gan amlinellu\u2019i chynnydd wrth roi\u2019r argymhellion ar waith. Mae ymateb Llywodraeth y DU i SPT yn gyfrinachol, er y gallai Llywodraeth y DU ddewis i gyhoeddi\u2019i hadroddiad.<\/p>\n<p>Os bydd Llywodraeth y DU yn methu cyd-weithio yn ystod ymweliad SPT, neu\u2019n methu \u00e2 rhoi argymhellion SPT ar waith, gall yr SPT gyhoeddi\u2019i adroddiad, neu ofyn i\u2019r <a href=\"https:\/\/humanrightstracker.com\/cy\/un-treaty\/confensiwn-yn-erbyn-artaith-a-thriniaeth-neu-gosb-greulon-annynol-neu-israddol-arall-cat\/\">Pwyllgor yn erbyn Artaith<\/a> wneud datganiad
