Government should: Review the Trade Union Act 2016. Ensure all workers enjoy full trade union rights without interference. Implement the Employment Relations Act 1999 (Blacklists) Regulations 2010 to prevent blacklisting of trade union members. Guarantee that blacklisted workers can take effective legal action and receive compensation.
Original UN recommendation
The Committee recommends that the State party undertake a thorough review of the new Trade Union Act 2016 and take all necessary measures to ensure that, in line with its obligations under article 8 of the Covenant, all workers enjoy their trade union rights without undue restrictions or interference. The Committee urges the State party to take all necessary measures to ensure the effective implementation of the Employment Relations Act 1999 and its Regulation 2010, which prohibit blacklisting of trade union members, and guarantee that all workers who have been blacklisted have access to effective legal remedies and compensation.
