Argymhelliad Cymreig clir

Dylai’r Llywodraeth:
(a) Adolygu sut mae newidiadau lles a wnaed ers 2010 wedi effeithio ar y grwpiau mwyaf agored i niwed a mynd i’r afael â’r effeithiau negyddol hyn. Mae hyn yn cynnwys dad-wneud polisïau fel y terfyn dau blentyn, y cap ar fudd-daliadau a’r cyfnod aros o bum wythnos am y taliad Credyd Cynhwysol cyntaf;
(b) Cynyddu gwariant ar nawdd cymdeithasol a sicrhau bod budd-daliadau, gan gynnwys budd-daliadau diweithdra a’r lwfans dyddiol ar gyfer ceiswyr lloches, yn cael eu diweddaru’n rheolaidd ar sail costau byw, gan ddefnyddio system annibynnol a thryloyw. Dylai’r newidiadau hyn roi safon byw ddigonol i hawlwyr budd-daliadau;
(c) Cynnal adolygiad annibynnol o’r rheolau ar gyfer bod yn gymwys ar gyfer nawdd cymdeithasol. Dylai’r adolygiad edrych ar doriadau dros dro i fudd-daliadau neu atal budd-daliadau dros dro a’r defnydd o system ddigidol awtomataidd a ddefnyddir i wneud cais am fudd-daliadau. Gwneud yn siŵr bod y rheolau hyn yn deg, dilyn y gweithdrefnau priodol a pheidio â’i gwneud yn anoddach i bobl wneud cais am fudd-daliadau na’u cadw;
(d) Gwneud yn siŵr bod budd-daliadau anabledd, fel y Taliad Annibyniaeth Personol (PIP) a’r Lwfans Cyflogaeth a Chymorth (ESA), yn talu’n briodol am y costau ychwanegol sydd gan bobl anabl oherwydd eu cyflwr neu nam. Dylai hyn ddilyn model hawliau dynol o ran anabledd ac ystyried argymhellion y Pwyllgor ar Hawliau Pobl ag Anableddau.
(e) Dilyn cyngor y CU ynghylch yr hawl i nawdd cymdeithasol a defnyddio datganiad y Pwyllgor ar symiau nawdd cymdeithasol sylfaenol (lloriau amddiffyn cymdeithasol) fel rhan allweddol o’r hawl i nawdd cymdeithasol a’r Nodau Datblygu Cynaliadwy (SDGau). Ystyried yr argymhellion a wnaed gan Rapporteur Arbennig y Cenhedloedd Unedig ar dlodi eithafol a hawliau dynol.


Original UN recommendation

The Committee urges the State Party, along with the devolved governments of Northern Ireland, Scotland and Wales:
(a) To assess the impact of the welfare reforms introduced since 2010 on the most disadvantaged groups and to take corrective measures, including reversing such policies as the two-child limit, the benefit cap and the five-week delay for the first Universal Credit payment;
(b) To increase its budget allocation for social security and ensure that social benefits, including unemployment benefits and the daily allowance for asylum-seekers, are regularly indexed to the cost of living through an independent and transparent mechanism to provide recipients with an adequate standard of living;
(c) To conduct an independent review of the eligibility criteria for social security, including the temporary reduction and suspension of benefits, and the reliance on a digital-only, automated approach to ensure that those measures are reasonable, comply with due process and do not create barriers to the uptake and maintenance of benefits;
(d) To ensure that disability-related benefits, including the Personal Independence Payment and the Employment and Support Allowance, adequately cover additional disability-related costs, in line with the human rights model of disability, taking into account the recommendations of the Committee on the Rights of Persons with Disabilities;
(e) To be guided by the Committee’s general comment No. 19 (2007) on the right to social security and refer to its statement on social protection floors as an essential element of the right to social security and of the Sustainable Development Goals, as well as the recommendations made by the Special Rapporteur on extreme poverty and human rights.
