Dylai’r Llywodraeth:
Adolygu’r strategaethau Gwrthderfysgaeth ac Atal, gan gynnwys y “ddyletswydd atal”. Dylid gwneud hyn i ddileu unrhyw effeithiau gwahaniaethol ac anghymesur ar hawliau dynol lleiafrifoedd ethnig ac ethno-grefyddol, gan gynnwys plant. Dylai atal y polisi “dyletswydd atal” a mabwysiadu mesurau i warantu nad yw strategaethau gwrthderfysgaeth yn arwain at broffilio a gwahaniaethu yn erbyn lleiafrifoedd ethnig ac ethno-grefyddol. Dylai hefyd sicrhau bod yna fecanweithiau monitro effeithiol ac annibynnol a mesurau diogelu rhag cam-drin mesurau presennol a bod pobl yr effeithir arnynt, gan gynnwys plant a’u teuluoedd, yn gallu cael mynediad at rwymedïau prydlon ac effeithiol a iawndal digonol.
Original UN recommendation
Recalling its previous concluding observations, the Committee urges the State party to revise the “CONTEST” and “Prevent” counter-terrorism strategies, including the “prevent duty”, with a view to eliminating any discriminatory and disproportionate impact on the human rights and fundamental freedoms of members of ethnic and ethno religious minorities, including children. It recommends that the State party suspend the “prevent duty” and adopt robust measures to guarantee that, for as long as these counter-terrorism strategies remain in force, they do not result, in purpose or effect, in profiling and discrimination against ethnic and ethno-religious minorities. It further recommends that the State party ensure that there are effective and independent monitoring mechanisms, as well as sufficient safeguards, against the abuse of the existing measures and that the persons affected, including children and their families, have access to prompt and effective remedies and adequate reparations.
