Argymhelliad Cymreig clir
Dylai’r llywodraeth: (a) Gymryd camau i ddelio gyda’r cyfraddau erlyn a chollfarnu isel ar gyfer cam-drin domestig a thrais rhywiol. Sicrhau bod pob achos o drais seiliedig ar rywedd, yn arbennig rhai yn ymwneud â gweithredoedd neu hepgoriadau gan awdurdodau’r llywodraeth, yn cael eu hymchwilio’n drylwyr ac yn arwain at erlyniad a chosb ble fo’n briodol, yn ogystal ag unioniad ac iawndal ar gyfer dioddefwyr a’u teuluoedd. (b) Ystyried newid arferion yr heddlu sy’n llesteirio menywod mudol sydd wedi goroesi neu sydd dan risg o drais seiliedig ar rywedd rhag ceisio amddiffyniad gan yr awdurdodau. (c) Darparu hyfforddant ofynnol ar erlyn trais seiliedig ar rywedd i’r holl swyddogion cyfiawnder a staff gorfodi’r gyfraith. Parhau gydag ymgyrchoedd codi ymwybyddiaeth nghylch pob ffurf o drais yn erbyn menywod. (d) Adolygu argaeledd ffoaduriaid, gwasanaethau cam-drin domestig a chanolfan cefnogaeth trais ar draws y Deyrnas Unedig, i sicrhau bod cynnydd mewn cyllid gan y llywodraeth ar gyfer gwasanaethau rheng flaen yn golygu y gall pob dioddefwr trais seiliedig ar rywedd gael mynediad at y gefnogaeth a gwasanaethau angenrheidiol. (e) Darparu data i’r CU ynghylch y nifer o gwynion, ymchwiliadau, erlyniadau, collfarnau a dedfrydau mewn achosion o drais seiliedig ar rywedd, yn ogystal â gwybodaeth am y camau a gymerwyd i sicrhau bod gan ddioddefwyr fynediad at unioniad ac adferiad. Dylid dadansoddi’r data yn ôl oed ac ethnigrwydd neu genedligrwydd y dioddefwyr. (f) Adolygu effeithiolrwydd mesurau i ddiogelu plant dan risg o anffurfio organau cenhedlu benywod a phriodas dan orfod yn y Deyrnas Unedig.
Argymhelliad gwreiddiol y CU
The State party should: (a) Take effective measures to address low prosecution and conviction rates for domestic abuse and sexual violence in the State party, and to ensure that all cases of gender-based violence, especially those involving actions or omissions by State authorities or other entities that engage the international responsibility of the State party under the Convention, are thoroughly investigated, that the alleged perpetrators are prosecuted and, if convicted, punished appropriately, and that the victims or their families receive redress, including adequate compensation. (b) Consider revising police practices that deter migrant women from seeking protection from the authorities in cases where they have been subjected to or are at risk of gender-based violence. (c) Provide mandatory training on the prosecution of gender-based violence to all justice officials and law enforcement personnel and continue awareness-raising campaigns on all forms of violence against women. (d) Carry out a review of the availability of refuges, specialist domestic abuse services and rape support centres, throughout the State party, to ensure that the provision of increased funding results in all women who are victims of gender-based violence in the State party having access to necessary support and services. (e) Compile and provide to the Committee statistical data, disaggregated by the age and ethnicity or nationality of the victim, on the number of complaints, investigations, prosecutions, convictions and sentences recorded in cases of gender-based violence, as well as on the measures adopted to ensure that victims have access to effective remedies and reparation. (f) Review the effectiveness of preventive and protection measures in place for children at risk of female genital mutilation and forced marriage in the State party.
